چکیده مقاله :
امروزه، وخامت بحران هاي زيست محيطي تا حدي است که حيات انسان و ساير موجودات بر کره خاکي را به مخاطره انداخته است. به همين دليل، مباني نظري تعيين کننده تعامل انسان با طبيعت، از جمله اخلاق، مورد توجه علاقه مندان به محيط زيست مي باشد و تبيين نظريه اخلاق زيست محيطي از منظر آرا و رویه های قضایی در نظام بین الملل ، از ضروريات حفاظت و بهره برداري از محيط زيست جهانی محسوب مي گردد. اخلاق زيست محيطي رايج، بر طيفي از مباني ارزش ذاتي قرار دارند که انسان محوري و زيست بوم محوري، دوسر آن را تشکيل مي‌دهند. در مقاله حاضر سعي شده است تا ديدگاه هاي اخلاق زيست محيطي با توجه به دو پرسش اساسي اخلاق درباره «محیط زیست جهانی» و «رویه های قضایی بین المللی» تشريح شوند و نشان داده شود که چرا تبيين اخلاق زيست محيطي مبتني بر ديدگاه نظام حقوقی بین المللی، ديدگاهي جامع تر براي حفاظت از محيط زيست مي باشد.از همين رو، در سال‌هاي اخير فاکتورهای اخلاقی در حقوق بين‌الملل محيط زيست به عنوان بخشي از نظم عمومي اجتماع بين‌المللي مورد توجه قرار گرفته است و همچنين به نحو فزاينده و برجسته‌اي با عملكرد ديوان بين‌المللي دادگستري ارتباط پيدا كرده است.
